The rules that govern your use of our platform.

Agreement to Terms

By accessing or using the Chinuch App educational platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these terms, you may not access the Service.

For Schools: These Terms are supplemented by the Master Service Agreement (MSA) and Data Processing Agreement (DPA), which govern the contractual relationship between schools and Chinuch App. Schools must accept the MSA and DPA during registration. These documents are available at /legal/schools.

2.

Description of Service

Chinuch App provides a comprehensive educational management platform for Jewish schools, including:

  • Student information management
  • Attendance tracking
  • Behavior incident logs
  • Bus and transportation check-in/check-out
  • Assessments, standards, and skills tracking
  • Gradebook and report cards
  • Parent and teacher communication
  • Student profiles
  • Staff and user management
  • Multi-school administration (if applicable)
  • AI-powered curriculum generation

The Company may update or improve features periodically.

3.

User Accounts

3.1 Account Creation

To use our Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

3.2 Account Types

  • School Administrator: Full access to school management features
  • Teacher: Access to class management and student records
  • Student: Access to assignments and personal academic records
  • Parent: View-only access to their children's records
4.

Acceptable Use Policy

You agree not to:

  • Use the Service for any unlawful purpose
  • Impersonate another person or entity
  • Share login credentials with unauthorized users
  • Attempt to gain unauthorized access to any portion of the Service
  • Upload malicious code or interfere with the Service
  • Use the Service to harass, abuse, or harm others
  • Scrape or copy content without permission
  • Violate any applicable laws or regulations, including FERPA, COPPA, and state student privacy laws

Privacy and Data Protection

Your use of our Service is also governed by our Privacy Policy. We are committed to protecting student privacy and comply with:

  • FERPA (Family Educational Rights and Privacy Act)
  • COPPA (Children's Online Privacy Protection Act)
  • PPRA (Protection of Pupil Rights Amendment)
  • IDEA (Individuals with Disabilities Education Act)
  • State student privacy laws (CA SOPIPA, NY Ed Law §2-d, CO SB 16-173, TX laws, etc.)

For Schools: The Data Processing Agreement (DPA) provides detailed information about how we process student data in compliance with these laws. See /legal/schools#dpa.

6.

Data Ownership and Export Rights

Schools own 100% of all Student Data. This includes:

  • Attendance records
  • Behavior logs
  • Bus logs
  • Assessments and standards data
  • Grades & report cards
  • Parent/guardian information
  • Student profiles
  • User accounts linked to the School
  • Communications

Schools may request an export of all Student Data at any time in machine-readable format (CSV, JSON, SQL, or equivalent). We will provide exports within 10 business days of request.

7.

Data Retention and Deletion

We retain student data only as long as necessary:

  • Active Schools: Data is retained while the school's account is active
  • School Termination: Data is archived for 60 days, then permanently deleted
  • School Requests: We delete specific student records within 10 business days of request
  • Audit Logs: Retained for 1 year for compliance, unless longer retention is required

8.

Security

We maintain industry-standard security safeguards, including:

  • Encryption in transit (HTTPS/TLS) and at rest
  • Secure authentication and password hashing
  • Role-based access controls
  • Audit logs
  • Network security filters
  • Regular backups
  • System monitoring
  • Incident response procedures

9.

Breach Notification

In the event of unauthorized access or disclosure of Student Data, we will notify affected schools within 72 hours of confirming a breach. Notifications will include:

  • Description of the incident
  • Data affected
  • Individuals impacted
  • Steps taken to contain the issue
  • Recommendations for schools
  • Contact for follow-up questions

10.

Intellectual Property

10.1 Our Content

The Service and its original content (excluding user-generated content) are owned by Chinuch App LLC (DBA Chabad Chinuch) and are protected by copyright, trademark, and other intellectual property laws. This includes:

  • The Platform and codebase
  • UI/UX designs and architecture
  • Documentation

10.2 User Content

Schools and users retain ownership of content they create. By uploading content, you grant us a license to use, store, and display your content as necessary to provide the Service. This includes:

  • Lesson plans and curriculum materials
  • Assessments and educational resources
  • Student work (with appropriate permissions)

10.3 Student Data Ownership

Schools own all Student Data. The Company has no ownership rights to Student Data. See Data Ownership & Export Statement for details.

11.

Payment Terms

If your school subscribes to a paid plan:

  • Fees are determined by school enrollment, feature tier, and billing cycle
  • Payment is due according to the selected billing cycle
  • Invoices are due within 30 days
  • Late payments may result in suspended access
  • Prices are subject to change with 30 days notice
  • Fees are non-refundable unless otherwise stated
  • Schools are responsible for all applicable taxes

Support & Maintenance

We provide:

  • Email support
  • Reasonable response times
  • Bug fixes and patching
  • Feature updates
  • Performance monitoring

Support is available to School administrators and authorized staff.

13.

SMS / Text Messaging Program

Program name: Chinuch App School Notifications.

13.1 Description

Schools using the Service may send transactional SMS text messages to parents, guardians, teachers, students, and authorized school staff who have provided a phone number and expressly opted in to receive messages. Messages relate to the educational relationship between the recipient and the school and include attendance alerts, dismissal and transportation updates, school-to-parent direct messages, homework hotline notifications, and one-time verification codes. We do not send marketing, promotional, lending, or third-party messages through this program.

13.2 Message frequency

Frequency varies. Typical volume is fewer than 10 messages per recipient per week during the school year. Schools may send time-sensitive messages (such as emergency closures) at any time.

13.3 Message and data rates

Msg & Data Rates May Apply. Standard message-and-data rates from your wireless carrier may apply to each message sent or received. Chinuch App and the school do not charge for SMS messages. Carriers are not liable for delayed or undelivered messages.

13.4 Help and opt-out

Reply HELP to any message for support information, or email support@chinuchapp.com. Reply STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, or OPTOUT) to any message to stop receiving SMS from that school’s sender number; you will receive a single confirmation message and no further messages. You can also turn off SMS at any time from parent notification settings. To resume after opting out, reply START or re-enable SMS in settings.

13.5 Privacy of phone numbers

Phone numbers and SMS opt-in information are collected solely to deliver these messages. Phone numbers and SMS opt-in information are not shared with third parties or affiliates for marketing or promotional purposes and are not sold or rented to anyone. 13.6 Consent is not required

Consent to receive SMS messages is not a condition of using the Service. You may use Chinuch App without enabling SMS and continue to receive in-app and email notifications instead.

14.

AI-Powered Features and Disclosure

The Service uses artificial-intelligence models (from providers including Anthropic, OpenAI, Google, Perplexity, and ElevenLabs) to assist with tasks such as generating lesson materials, drafting parent communications, transcribing speech, grading open-ended student responses, and building remediation packets. By using the Service, you acknowledge and agree to the following:

14.1 AI output is a draft, not truth

AI-generated content may contain inaccuracies, biases, or errors. All AI-generated report-card narratives, parent emails, remediation plans, and grading suggestions must be reviewed by a qualified human (teacher, administrator, or parent) before being treated as authoritative. Chinuch App does not warrant that AI output is accurate, complete, pedagogically optimal, or suitable for any particular student.

14.2 AI disclosure to students

Content shown to a student that was produced by AI is visibly labeled as "AI-generated" and includes a way to report inappropriate output. Users under 18 interacting with AI-backed features will be informed that they are communicating with an AI assistant and not a human.

14.3 PII handling

Before any prompt leaves our servers, it passes through a centralized PII-scrub that removes or replaces a child's name, email, phone, street address, date of birth, NYC OSIS / school ID, parent contact information, and medical or financial identifiers. See Section 14 of our Privacy Policy and Section 6 of our COPPA Notice for full detail on how we sanitize outbound AI requests.

14.4 Child-safety policy

Every AI call that can reach a minor is wrapped with a non-negotiable child-safety preamble that prohibits sexual, violent, self-harm, substance-use, weapons, political, and age-inappropriate content, in line with the providers' own policies for organizations serving minors. We prohibit use of the Service to elicit or produce such content.

14.5 Prohibited uses of AI features

You may not use AI features to:

  • Produce content targeting a specific child with harassment, shaming, or content that a reasonable educator would not produce.
  • Impersonate a real person (teacher, parent, rabbi, clinician).
  • Generate medical, psychological, legal, or safety advice presented as authoritative.
  • Attempt to extract training data, model weights, or prompts from the underlying providers.
  • Bypass or defeat the safety guardrails or PII scrubbing described above.

14.6 No training on customer data

Our AI subprocessors are contractually prevented from using your data, your school's data, or your students' data to train their models.

14.7 AI credit pools

Some AI features consume a per-school token allowance. Usage is logged per user and per school and is visible to school administrators. Exceeding the allowance may temporarily disable AI-backed features until the next billing cycle or until additional credits are purchased, without affecting the rest of the Service.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • Warranties of merchantability and fitness for a particular purpose
  • That the Service will be uninterrupted or error-free
  • The accuracy or reliability of any information obtained through the Service
16.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Neither party is liable for indirect or consequential damages
  • The Company's total liability is limited to fees paid in the previous 12 months
  • CHABAD CHINUCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE
17.

Indemnification

School Indemnifies Company: For claims arising from misuse of the Platform, violation of laws by School personnel, improper sharing of data, or inaccurate data entered into the system.

Company Indemnifies School: For claims arising from negligent handling of Student Data or breaches caused by Company systems.

18.

Termination

Either party may terminate for:

  • Breach of Agreement
  • Failure to pay fees
  • Security concerns
  • School request (with 30 days written notice)

Upon termination:

  • All School data will be deleted within 60 days
  • The School may request a full export before deletion
  • Access will be disabled

All rights to data export remain intact.

19.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state in which Chinuch App LLC is registered, without regard to its conflict of law provisions.

20.

Entire Agreement

These Terms, combined with:

constitute the entire understanding between the parties.

21.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or platform notification. Continued use after changes constitutes acceptance of the updated Terms.
